Podcast Studio Rental Agreement for
Your Viewing Pleasure
What Cheer Writers Club welcomes Club Members’ use of its recording room. Reservations are required to rent the recording room at What Cheer Writers Club. All reservations must be made via Writers Club’s staff. You are required to be present for the entire duration of your rental reservation.
Acceptance of Terms
Description of Services
Writers Club may provide you with access to the Podcasting Studio and recording equipment including, but not limited to, microphones, headphones and audio recording equipment (collectively, "Services"). The Services at all times are subject to the TOU.
Writers Club is not responsible or liable for any failure or delay in providing Services arising out of or caused by forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss of malfunctions of utilities, communications or computer (software and hardware) services.
Use of services
You agree that when participating in or using the Services, you will not:
Use the Services to disseminate or invoke hate speech that includes comments regarding race, religion, ethnicity, nationality, sex, gender identity, sexual orientation, disability, or anything that constitutes harassment;
Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
Publish, post, upload, distribute, or disseminate any unlawful content, plagiarized content, intellectual property, or applications and software content that breaks state law
Restrict or inhibit any other user from using and enjoying the Services.
Violate any applicable laws or regulations.
Participation in or Use of Services
You acknowledge that you are participating in or using the Services at your own free will and decision. You acknowledge that Writers Club does not have any liability with respect to your access, participation in, use of the Services, or any loss of, loss from theft, or damage of information or personal property resulting from such participation or use.
Writers Club is not responsible for any property you leave behind in our Premises. It is your responsibility to ensure that you have retrieved all of your personal items prior to leaving. You must clean up the Podcasting Studio and leave it in the condition in which it was found. A fee may be assessed for any special cleaning or repairs.
Guests and Invitees
Rental of the Podcasting Studio allows up to 3 guests. Thus, the maximum guest availability, including you, for the recording room is 4 individuals. You must meet your guests at the reception desk and escort them to the Studio. Guests may use the restrooms. If they are potential Writers Club members or patrons, your guests can request a guided tour of the entire facility from our staff. Otherwise, guests should not roam or use other rooms in the facility, and should refrain from noise or lengthy conversations in the other areas of the facility.
You are liable for the full cost of any damages caused by you or your guest(s) to any property in the space, owned either by the Writers Club or its members. Writers Club is not responsible for any property you or your guests leave behind in our Premises. It is your responsibility to ensure that you or your guests have retrieved all personal items prior to leaving.
Payments, Refunds, and Cancellations
All rental fees are due at the time of reservation. Cancellation of any Room reservations must be made 24 hours prior to commencement or you will be charged the full amount of your reservation. If cancellation of any Room rental is made before 24 hours prior to commencement, you will be refunded the full amount of any rental fees.
This TOU must be adhered to at all times. Failure to follow this TOU can result in dismissal of you and/or your guests from the Writers Club space with no refund. Writers Club reserves the right to refuse recording room rental to anyone who has previously violated this TOU.
Food and Beverages
No food is to be allowed in the Podcasting Studio. Beverages are allowed, but this does not include alcoholic beverages.
Writers Club prohibits harassment of any kind, including sexual harassment, and will take appropriate and immediate action in response to complaints or knowledge of violations of this policy. Appropriate action may include immediate expulsion from the premises. For purposes of this policy, harassment is any uninvited or otherwise one-sided verbal or physical conduct, including, but not limited to, racial or ethnic slurs, flirtation and crude remarks, designed to threaten, intimidate or coerce a member, employee, or guest of Writers Club.
Unfortunately, no pets or animals are allowed in the Writers Club space unless required as a Service Animal.
What Cheer Writers Club ‘Spot’
We request that all podcasts, vlogs and other recordings and streams include a short ‘spot’ noting that the content was recorded at What Cheer Writers Club’s Podcast Studio, a nonprofit studio in downtown Providence RI.
You will find suggested wording in the Studio. By signing this agreement, you agree that you will include this spot unless you have written permission from the Staff to not include it due to reasons of content topic or audience.
In the event that any provision or portion of this TOU is determined to be invalid, illegal or unenforceable for any reason, in whole or in part, the remaining provisions of this TOU shall be unaffected thereby and shall remain in full force and effect to the fullest extent permitted by applicable law.
